Morris James LLP's Bankruptcy and Creditors' Rights Group represents and advises parties with respect to federal bankruptcy law and state collection and enforcement laws.
In commercial bankruptcy matters, we represent clients in courts throughout the country in both reorganization and liquidation cases. The group primarily represents secured and unsecured creditors (including landlords, equipment lessors, lenders and insurance companies), official and unofficial committees, purchasers, investors, and other parties in interest. In addition, we defend parties in preference and fraudulent conveyance actions. We also represent debtors and trustees.
In state law proceedings, we assist creditors in workouts and collection efforts, by pursuing and enforcing their state law rights and remedies. For example, we have foreclosed on property, recovered assets through replevin actions, and obtained, enforced and collected judgments through levy, execution and garnishment. We have obtained charging orders against partnerships and limited liaibility companies. In addition, where practicable, we have counseled clients in out-of-court workouts and debt restructurings.
In addition to acting as lead counsel, we have an extensive practice serving as local counsel for out-of-state law firms. In such role, we provide guidance on the rules and procedures of the local courts, as well as insight on the substantive law.
